These General Terms and Conditions of Sale govern the sale of products made online through the e-commerce service on the website sikeliaparfums.com. Given the large number of products available, their main features and prices (including any additional costs) are clearly indicated directly on the website. Products sold on the site may only be purchased and delivered to the countries indicated in the Order Form. Any orders for shipments to be made outside of these countries will be automatically rejected during the Order processing procedure.

GENERAL TERMS AND CONDITIONS OF SALE FOR ONLINE PURCHASES ON THE SITE

These General Terms and Conditions of Sale (“Terms”) are governed by the Italian Consumer Code (Legislative Decree no. 206/2005 as amended) and by the provisions on electronic commerce (Legislative Decree no. 70/2003 as amended), and apply exclusively to the remote sale via web of the Products shown on sikeliaparfums.com, for which the “Buy Online” button is available, and the Services as described herein and in other sections of the website.
If these Terms are amended, the version in force at the time the Customer (the “Customer”) places their Purchase Order shall apply to the Order. These Terms govern the offer, submission and acceptance of purchase orders for products on sikeliaparfums.com, but do not govern the supply of services or sale of products by parties other than the Seller that may be present on the website via links, banners or other hypertext connections. Before submitting orders to and purchasing products or services from third parties, we recommend you verify their terms and conditions, as the Seller is not responsible for services provided by third parties.

Products are sold to the Customer identified by the data provided in the electronic Order Form with simultaneous acceptance of these Terms. The product offers on the website sikeliaparfums.com are aimed at adult customers. If you are under 18, you must obtain consent from a parent or legal guardian before making purchases on the site. Remember: this applies not only to our website but to all sites you visit online. If while browsing you see or are asked for information you do not understand, always ask your parents for help. By placing an Order on this website, you warrant that you are of legal age (18) and have the legal capacity to enter into binding contracts.
It is forbidden for Customers to enter false, invented, or fictitious names in the online Order procedure or further communications. The Seller reserves the right to prosecute any violations or abuse in the interests of and to protect consumers.
By accepting these Terms, you also release the Seller from any liability arising from the issuance of incorrect fiscal documents due to errors in the data provided by you when placing your Order online, being solely responsible for their accuracy. You further release the Seller from liability for any errors or delays in accessing the website when entering your data, the slowness or inability to receive the Order Confirmation, or any anomaly caused by internet issues or other unforeseeable circumstances independent of Sikelia Parfums.


You also release the Seller from any liability arising from the non-functionality or issues related to the email address provided for sending the Order Confirmation.

OFFER TO THE PUBLIC AND CONTRACT OF SALE THROUGH E-COMMERCE SERVICE

The Products and Services with their respective Prices as shown on the Website constitute a public offer in accordance with the methods specified in the General Terms and Conditions of Sale and in the Website itself. The conditions of such offer apply exclusively to purchases made on the website sikeliaparfums.com. The sales contracts concluded on the Website and relating to the Products and Services (hereinafter the “Contract of Sale” or simply “Contract”) are entered into with Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan. By “online Contract of Sale” is meant the distance contract concerning the sale of movable goods (hereinafter “Products”) concluded between you, in your capacity as Customer, and Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, in its capacity as Seller, within the framework of an e-commerce service organized by the Seller which, for this purpose, uses the distance communication technology known as Internet.

To conclude the Contract for one or more Products, you must fill in the Order Form in electronic format (hereinafter also “Order”) and transmit it to the Seller via the Internet following the relevant instructions. The Order contains the reference to these General Terms and Conditions of Sale; information and images of each Product and the corresponding price; the payment methods you may use; the methods of delivery of the purchased Products, the times and the related shipping and delivery costs; the reference to the conditions for exercising your right of Withdrawal; the methods and time limits for returning the purchased products.

Although Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, constantly adopts measures aimed at ensuring that the photographs shown on the Website are faithful reproductions of the original products, including the adoption of every possible technological solution to minimize inaccuracies, some variations may still occur due to the technical characteristics and the color resolution characteristics of the computer you use. Consequently, the Seller shall not be liable for any inadequacy of the graphic representations of the products shown on the Website if due to the aforementioned technical reasons, since such representations have a merely illustrative function.

ORDER FULFILLMENT AND CONTRACT CONCLUSION

By transmitting the Order through the Website, you unconditionally accept and agree to comply, in your dealings with the Seller, with these General Terms and Conditions of Sale. Once the Order has been sent, the Seller will process it for fulfillment and will send you, by email, an Order Confirmation (hereinafter the “Order Confirmation”) to the email address provided by the Customer. This Confirmation will summarize the selected Products and Services, their Prices (including delivery costs and any additional charges related to any additional Services requested by the Customer), the delivery address, the Order Number (hereinafter the “Order Number”), the General Terms and Conditions of Sale contained therein and any Specific Conditions applicable to the individual Order as determined following specific requests by the Customer.

Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, reminds the Customer to carefully and thoroughly check the correctness of the data contained in the Order Confirmation and to communicate any corrections within 24 hours of receipt. The Order Number, generated by the system and communicated by Sikelia Parfums, must be used by the Customer in any communication.

Occasional unavailability of the Products offered may occur. In such cases, if the Products chosen by the Customer are, in whole or in part, unavailable, Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan – VAT no.: 11170160961 – Tel: (+39) 328 752 8254 – Email: info@sikeliaparfums.com will inform the Customer.

The Seller also reserves the right, before sending the Order Confirmation, to request by email or by telephone (using the details you provided) additional information regarding the Order you submitted via the Internet.

The Seller may decide not to process your purchase orders if they do not provide sufficient guarantees of solvency or are incomplete or incorrect, or in the event of product unavailability. In such cases, we will inform you by email that the Contract has not been concluded and that the Seller has not processed your Order, specifying the reasons. In such a case, the amount previously reserved on the Customer’s payment method will be released.

If the products displayed on the Website are no longer available or on sale after your Order has been sent, the Seller will inform you promptly and in any event within 30 working days from the day following the date you submitted your Order, of the possible unavailability of the ordered Products. In such a case, the amount previously reserved on the Customer’s payment method will be released.

Each sale made by the Seller through the online sales service may concern one or more products, without limitation of quantity per item.

Before concluding the Contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and the Privacy Policy concerning the processing of personal data.

The Contract is concluded when the Seller, having received your Order Form and verified the correctness of the data, has sent you to the email address you indicated via the Website the confirmation of shipment of the product.

The Seller undertakes to deliver the products ordered by the Customer within no more than 30 days from the date of conclusion of the Contract.

The language available for concluding the Contract with the Seller is Italian, and the applicable law is Italian law.

Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan reserves the right to refuse orders from a customer with whom there is an ongoing legal dispute relating to a previous Order. This also applies to all cases in which Sikelia Parfums deems the customer unsuitable, including, for example, in the case of previous violations of the conditions of the Contract for online purchases on the Website or for any other legitimate reason, especially if the customer has been involved in fraudulent activities of any kind.

SALE PRICES

Unless otherwise indicated in writing, all prices of the Products and the shipping and delivery costs indicated on the Website and in the Order are understood to be VAT included and expressed in Euros. The validity of the prices indicated is always and exclusively that shown on the Website at the time the Order is submitted via the Internet.

The prices of the Products, offers, and shipping and delivery costs may vary over time. If you submit the order some time after your last visit to the Website, please make sure that the prices have not changed and therefore check the final sale price before submitting the related Order.

All Products are shipped directly from Italy. The prices of the Products and the shipping and delivery costs indicated on the Website and in the Order, unless otherwise specified, do not include any costs related to customs duties and related taxes, which cannot be calculated in advance if the shipment takes place to non-EU countries or to countries where the applicable legislation provides for import duties.

In such cases, the existence of any additional costs as mentioned above will be clearly stated during the Order entry and review phase. These costs are therefore borne by the Customer and must be paid directly at the time of delivery of the Products, according to the instructions specified in the Order Confirmation.

In case of failure to collect the shipment, the Seller will refund the cost of the product but not the shipping costs, exit and entry costs related to customs duties and related taxes, and the shipping costs for returning the product to the Seller.

All Product Prices indicated on the Website are inclusive of VAT. Delivery costs (hereinafter “Delivery Costs”) and costs relating to Additional Services made available by Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, as indicated in the following articles of these General Terms and Conditions of Sale, are borne by the Customer and duly detailed in the Purchase Order.

The Products and Services are subject to the Price displayed on the Website at the time the Order is submitted, unless there are offers or any subsequent Price changes indicated on the Website itself.

ORDER

The Purchase Order must be placed online through the order procedure available on the Website by clicking on the desired product, which will then be added to the Cart.

To proceed with completing the Purchase Order, the Customer may alternatively follow these methods:

  • If the Customer is already registered on the Website via the appropriate Section, it will be sufficient to enter their login credentials (username and password) in the “Login” Section.

  • If the Customer is not a user of the Website, it will be sufficient to enter the required data in the appropriate form necessary to complete the Purchase.

Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, reminds the Customer that, before proceeding with the Purchase, they may at any time become a user of the Website by registering online through the “Login” page (to become a Website User).

The Customer correctly completes the Order Procedure if the Website does not display any error messages (the system cannot detect errors regarding the data entered by the Customer in the fields dedicated to billing and shipping addresses).

In the “Your Orders” section, you can check the status of your Order, which can no longer be modified if it is in the status “in process,” “ready,” “shipped,” or “closed.”

If the Order has not yet been shipped, it is only possible to change the shipping address by contacting Customer Service via the contact page. It is recommended to notify the request for address change by email in advance and to follow up with a phone call.

If the delivery is unsuccessful, the Customer must immediately contact Sikelia Parfums, a brand of ASD Group s.r.l., Via Vincenzo Monti 34 – 20123 Milan.

PAYMENT METHODS

For payment of the price of the Products and the related shipping and delivery costs, you may use one of the methods indicated in the Order form on the Website, which are summarized below.

Credit and prepaid cards
The Customer may make payment by credit or debit card (Visa, Mastercard, Visa Electron and/or other similar cards) through the online credit card payment system, PayPal, or by bank transfer.
Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, uses the highest commercially available security measures. For online orders on our Website, we accept payments by both credit card and prepaid cards (for example, PostePay) without any additional charge on the product or shipping cost.

It is understood that the Customer must be the holder of a valid credit card at the time of the Order of Products purchased online and that the name shown on the credit card must be the same as that indicated in the billing details. If these requirements are not met, it will not be possible to proceed with the Order.

At the time of online purchase, together with the Order Confirmation, the reference bank will only reserve the amount relating to the Order from the available funds on your credit card. The amount will be immediately charged when the payment is sent via the online platform.

No computer archive of the Seller will store such data.

Bank transfer
You can pay for your Order quickly and securely using your home banking via the payment platform. The amount will be debited directly from your current account and the shipment will take place after the credit has been received.

The payment of the Order must be made at the time it is submitted to Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan – VAT no.: 11170160961 – Tel: (+39) 328 752 8254 – Email: info@sikeliaparfums.com, with the possibility that the Order may be automatically cancelled by the Seller if the credit is not received within no later than 7 days thereafter.

You will find the payment receipt, or the invoice if you are a VAT-registered entity, on the Website in the “Your Orders” section.

SHIPPING AND DELIVERY METHODS

Each shipment includes: the ordered product(s); any accompanying documentation required depending on the country of shipment; any informational and marketing material; any gadgets.

The delivery of Products purchased via the Seller’s Website may take place in different ways.

Home delivery to the Customer
The purchased products will be delivered by the carrier appointed by the Seller to the shipping address indicated by the Customer in the Order with insured shipment.

Please refer to the “24h Shipping” section for additional information on costs, delivery times, shipping methods, and serviced countries.

Upon receipt of the goods at your home address, you are requested to check the integrity of the packages at the time of delivery by the courier. In case of anomalies, you must report and record them exactly with the courier and refuse delivery, while also mandatorily notifying Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan – VAT no.: 11170160961 – Tel: (+39) 328 752 8254 – email: info@sikeliaparfums.com, also by contacting Customer Service via the contact page.

In Italy, we ship by express courier within 24/72 hours with insured delivery and signature upon delivery. Abroad, we ship by express courier, and delivery times vary depending on the country.

When the Order is shipped, you will receive an email with the shipment tracking code, that is, the tracking number with a link to the courier’s website and the status of the shipment. This number, the tracking code, is used to monitor the progress of the shipment and the estimated delivery date.

Orders with items immediately available and paid by credit card or PayPal placed by 4:00 p.m. are shipped the same evening or within 24 hours if the item is located in one of our stores.

For all orders that include items on pre-order, the date is indicated at the time of Order confirmation.

The Order may not be fulfilled if the shipping costs have changed in such a way that they do not cover the expenses the Seller must incur.

RIGHT OF WITHDRAWAL

If the Customer is a “Consumer,” as defined in Article 3 of the Italian Consumer Code, they are entitled to the rights provided for in Articles 52 and following of the Consumer Code, as amended by Legislative Decree of 21/02/2014 no. 21, and thus the right to withdraw from the Purchase Contract for any reason, without explanations and without any penalty, by notifying the Seller within 14 days, starting from the day on which the Customer or a third party designated by the Customer, other than the Carrier, acquires physical possession of the goods.

However, as a commercial choice and to better meet customer needs, a period of 30 days is granted to exercise the withdrawal, starting from the day on which the Customer or a third party designated by the Customer, other than the Carrier, acquires physical possession of the goods.

Please note that, as provided by current legislation, the right of withdrawal is excluded and therefore cannot be exercised if the products you purchased have been customized, even with simple engravings, or have been made to measure for you at your express request at the time of placing the Order.

The Withdrawal may concern all (Total Withdrawal) or only part (Partial Withdrawal) of the Products purchased by the Consumer from Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan.

The Customer wishing to exercise the right of withdrawal must notify Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, by explicit declaration, filling in the Withdrawal Form and sending it to the Contacts indicated, or by accessing the Website in the “Privacy Policy” section.

The right of withdrawal is subject to the following conditions: the returned Products must be returned in their entirety and not in parts or components of them, even in the case of kits; the returned Products must not have been used, worn, washed, or damaged; the returned Products must be returned in their original packaging (meaning the packaging of the individual product); the returned Products must be sent to the Seller in a single shipment.

Withdrawal Form
In case of exercising the right of withdrawal, the Customer is required to return the goods within 30 days from the day on which they notified Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, of their decision to withdraw from the Contract pursuant to Article 57 of Legislative Decree 206/2005.

The return can be requested through the Sikelia Parfums Website within 30 days of receiving the items. After logging in to the Website and entering your login credentials, access the “Privacy Policy” section, select the relevant Order, and request the return.

After requesting the return, select the product(s) you wish to return.

It is important that you contact Customer Service via the contact page to inform us of the day you wish the courier to collect the package and the time slot, morning or afternoon.

You must place the items to be returned inside a well-sealed and protected box or envelope. The courier will already have the label with our shipping address and the reference of the Customer who placed the Order, so it is not necessary to write anything on the package.

The goods must be returned intact, in the original packaging, complete in all their parts (including packaging and any documentation and accessories: manuals, cables, etc.), and with the attached fiscal documentation.

Without prejudice to the right to verify compliance with the above, Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, will refund the amount of the products subject to withdrawal within a maximum period of 30 days, including any shipping costs.

As provided by applicable law, to which reference is made, Sikelia Parfums reserves the right to suspend the refund until receipt of the goods or, at its sole discretion, until the Customer has provided proof of having returned the goods to Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan – VAT no.: 11170160961 – Tel: (+39) 328 752 8254 – email: info@sikeliaparfums.com.

Pursuant to Article 59 of the Consumer Code (“Exceptions to the right of withdrawal”), for distance and off-premises contracts, the right of withdrawal is excluded in the case of “the supply of goods made to measure or clearly personalized.”

REFUND METHODS

If the right of withdrawal is exercised by you in compliance with the aforementioned conditions, the Seller is required to refund the amounts paid by the customer within and no later than 30 days from your decision to exercise the right of withdrawal, provided that within the same period the product has been returned and verified by the operators of Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan – VAT no.: 11170160961 – Tel: (+39) 328 752 8254 – email: info@sikeliaparfums.com.

The Seller will use the same payment method you used for the initial transaction to issue the refund, unless you have explicitly requested the Seller to use a different method and the Seller has agreed.

If the Order was paid via PayPal, the refund will be credited to the card or PayPal account used for the payment. If the Order was paid by credit card, the refund will be credited to the card used for the payment (it is not possible to use another card for the refund).

If the Order was paid by bank transfer, the refund will be made by bank transfer: please contact Customer Service via the Contact page to provide us with the IBAN to which the refund should be issued.

Returns are processed by Customer Service within approximately one working week. Refund times to cards or current accounts depend directly on the banks, which generally take about 2–3 working days to credit the amount.

In case of a simple withdrawal, the only costs at your expense will remain the initial shipping costs of the Order of purchased products. If you have chosen a type of delivery different and more expensive than the standard one offered, the additional costs will not be refunded.

All other expenses will be refunded by the Seller, including the costs of returning the goods as a result of exercising the right of withdrawal (except for any additional costs arising from your possible choice to use a different and more expensive delivery method compared to the standard delivery offered by the Seller).

The only case in which the customer is entitled to a refund of the price, shipping costs, and return costs is for the return of defective products or products delivered that do not correspond to the Order placed by the customer or in case of damage to them due to transport or shipping errors by the Seller itself.

In case of return of the products listed above, Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan – VAT no.: 11170160961 – Tel: (+39) 328 752 8254 – email: info@sikeliaparfums.com will bear the transport costs for returning the products.

The return can be requested within 30 days of receiving the items. If possible, reseal the item or items to be returned inside the same box used for our shipment; if this is not possible, we recommend, for safety reasons, that the return be well packed and protected.

The courier will already have the pre-printed label with our shipping details and the customer reference, so it is not necessary to write anything on the package.

LEGAL WARRANTY OF CONFORMITY

All Products sold on the Website are covered by the Legal Warranty of Conformity provided for by Articles 128–135 of the Italian Consumer Code (“Legal Warranty”).

More precisely, the warranty regime for products sold by Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan – VAT no.: 11170160961 – Tel: (+39) 328 752 8254 – email: info@sikeliaparfums.com differs depending on whether the buyer is a “consumer” or a “professional” as defined by Directive 1999/44/EC on “certain aspects of the sale of consumer goods and associated guarantees.”

If you purchase as a “consumer,” you benefit from the legal warranty of conformity to which the seller is bound by law for each good sold (“Legal Warranty”).

The Legal Warranty—applicable to Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, in its capacity as seller—guarantees the goods against any lack of conformity with the sales contract.

TO WHOM IT APPLIES

The Legal Warranty is therefore reserved for consumers. It applies exclusively to users who have made a purchase on the Website for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity that may be carried out.

For those who have purchased on the Website and who do not qualify as consumers, the warranties for defects in the item sold, the warranty for lack of promised and essential qualities, and the other warranties provided for by the Italian Civil Code shall apply, with the related terms, forfeitures, and limitations.

WHEN IT APPLIES

The seller (and therefore, in relation to purchases made on the Website) is liable to the consumer for any lack of conformity existing at the time the product is delivered and which becomes apparent within two years from delivery.

The lack of conformity must be reported to the seller, under penalty of forfeiture of the warranty, within two months from the date it was discovered.

The warranty is therefore valid provided that the following conditions are met: the defect appears within 24 months from the date of delivery of the products; the Customer submits a formal complaint regarding the defects within a maximum of two months from the date the defect was recognized, unless this is in contrast with overriding mandatory provisions of the Customer’s country of habitual residence.

Unless proven otherwise, it is presumed that any lack of conformity which becomes apparent within six months of delivery of the product already existed on that date, unless this presumption is incompatible with the nature of the product or the nature of the lack of conformity.

From the seventh month following delivery of the product, it will instead be the consumer’s responsibility to prove that the lack of conformity already existed at the time of delivery.

To take advantage of the Legal Warranty, you must first provide proof of the date of purchase and delivery of the goods.

It is therefore advisable that, for this purpose, you keep the purchase invoice or any other document that can certify the date of purchase (for example, the credit card statement) and the date of delivery.

WHAT IS A LACK OF CONFORMITY

A lack of conformity exists when the purchased product is not suitable for the use for which goods of the same type are normally used, does not conform to the description made by the seller and does not possess the qualities of the product that the seller presented to the consumer as a sample or model, does not have the usual qualities and performance of a product of the same type that the consumer can reasonably expect, also taking into account statements made in advertising or labeling, or is not suitable for the particular use intended by the consumer and brought to the attention of the seller at the time of conclusion of the Contract, which the seller accepted.

Therefore, any faults, malfunctions, or defects of any other kind resulting from accidental events or from your responsibility or from use of the product not in accordance with its intended purpose and/or with the technical documentation attached to the product, if any, or with the instructions for use relating to it, are excluded from the scope of the Legal Warranty.

Regarding watches, accessories such as the strap, the case, and the glass are generally not covered by the warranty.

Consequently, the Seller shall not be held responsible for any inadequacy in the graphic representations of the products displayed on the Website if due to the aforementioned technical reasons, since such representations are for illustrative purposes only.

WHAT TO DO IN THE PRESENCE OF A LACK OF CONFORMITY

In the event of a lack of conformity duly reported within the applicable time limits, you will be entitled, primarily, to the free repair or replacement of the product, at your choice, unless the requested remedy is objectively impossible or excessively burdensome compared to the alternative remedy and, therefore, in the specific case, considering the type of sale, to replacement, where this is possible in relation to the number of units still available for sale.

Secondarily (that is, in the event that repair or replacement are impossible or excessively burdensome, or if repair or replacement have not been carried out within a reasonable time frame, or if the repair or replacement previously carried out have caused considerable inconvenience to the consumer), you are entitled to a price reduction or termination of the Contract, at your choice.

“Excessively burdensome remedy” means a remedy that imposes unreasonable expenses on the seller in comparison with alternative remedies that can be pursued, taking into account (i) the value the product would have if there were no lack of conformity; (ii) the significance of the lack of conformity; (iii) whether the alternative remedy could be pursued without significant inconvenience for the consumer.

REFUND OR REDUCTION AS A CONSEQUENCE OF THE APPLICATION OF THE LEGAL WARRANTY

In the event of termination of the Contract, Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, will refund you the Total Amount Paid. In the event of a price reduction, Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan – VAT no.: 11170160961 – Tel: (+39) 328 752 8254 – email: info@sikeliaparfums.com will refund you the amount of the reduction previously agreed upon.

The amount of the refund or reduction will be communicated to you by email and credited using the payment method or solution you selected.

In particular, in the event of a lack of conformity, the Customer who entered into the Contract as a Consumer shall be entitled to have the conformity of the products restored free of charge, through repair or replacement, or to obtain an appropriate price reduction or termination of the Contract in relation to the disputed goods and the consequent refund of the price.

The replacement or refund of a product with evident manufacturing defects will be possible within 7 days of receipt; beyond this time frame, if the item falls within the specifications of the service centers (different for each brand), it may be repaired under warranty.

Repair times under warranty vary depending on the brand of the products and can range from 45 to 60 working days.

The Customer acknowledges, accepts, and consents to the fact that all communications, notifications, confirmations, information, statements, and any documentation regarding transactions carried out relating to the purchase of the Products will be sent to the email address provided at the time of registration, with the option to download the information to a durable medium in the manner and within the limits provided by the Website.

In particular, if the Customer qualifies as a Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the Consumer, in accordance with the applicable law.

If, on the other hand, the Customer does not qualify as a consumer, the parties expressly agree to the exclusive jurisdiction of the Court of Patti.

The amended General Terms and Conditions of Sale shall become an integral part of new Contracts starting from the first Order placed by Customers after their publication on the Website.

For Orders already placed before such communication, the previous version of the General Terms and Conditions of Sale shall continue to apply.

SEVERABILITY CLAUSE

If any present or future provision of the General Terms and Conditions of Sale and/or the Contract should be or become wholly or partially void and/or ineffective or if there is a gap in the provisions of the General Terms and Conditions of Sale and/or the Contract, the remaining provisions of the General Terms and Conditions of Sale and the Contract shall in any case remain valid and effective.

It is understood that Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, and the Customer shall undertake to negotiate in good faith to supplement the gap or replace the void and/or ineffective clause with the aim of achieving the same results pursued by the invalid or ineffective clause and of safeguarding the content, including the economic substance, of the Contract.
