RETURNS AND REPLACEMENTS
These General Terms and Conditions of Sale (hereinafter referred to as the "General Terms") apply to all sales of products (hereinafter referred to as "Products" or "Product") purchased through the website sikeliaparfums.com (hereinafter the "Website"). The use of the distance selling service described in these General Terms is reserved exclusively for consumers (hereinafter the "Customers" or the "Customer"), meaning natural persons acting for purposes unrelated to any commercial, entrepreneurial, or professional activity they may carry out. The language available to conclude the contract is Italian. The Customer is required to carefully read the General Terms, which have been made available on the Website, in order to allow their storage and reproduction by the Customer in accordance with Article 12 of Legislative Decree no. 70 of April 9, 2003. Contracts concluded with Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan (as defined below), through the Website are governed by Italian law and, in particular, by Legislative Decree no. 206 of September 6, 2005 ("Consumer Code") and Legislative Decree no. 70 of April 9, 2003 ("E-commerce Decree").

Information Regarding Products
Information regarding the Products available for distance selling through the Website, along with their respective product codes, is available on the Website. Such information is provided in compliance with Articles 52 and 53 of the Consumer Code.
Price
The prices of the products are inclusive of all taxes and duties except for customs duties (see paragraph 10). All prices are expressed in Euros. Shipping costs are borne by the Customer, unless otherwise specified in promotions and as shown on the shipping cost page. Prices and promotions are valid only on the online shop sikeliaparfums.com.
Product Orders
The essential characteristics and prices of the Products are shown in the offer relating to each Product. To purchase the Products, the Customer must complete and send to Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan, the order form in electronic format, following the instructions contained on the Website. The Customer must place the Product in the appropriate "cart" and, after having read the General Terms, with particular reference to the delivery costs and the procedures for exercising the right of withdrawal, and the Privacy Policy, must select the desired payment method and choose the "Confirm Order" option. Before submitting their purchase order, the Customer will have the possibility to correct any data entry errors by following the appropriate editing procedure provided on the Website. In particular, the Customer has the option to change the quantity of Products they intend to purchase, adding or removing one or more Products from the "cart". By submitting the order, the Customer acknowledges and declares to have read all the instructions provided during the purchase procedure and to accept fully the General Terms. The Customer can view and track their order status in the "Orders" area of their account. Sikelia Parfums, a brand of ASD Group s.r.l., Via Chiara, 5 – 20155 Milan reserves the right to evaluate the acceptance of the orders received. Sikelia Parfums will notify the Customer of any inability to accept orders received within 30 days from the day following that on which the Customer sent the order and will arrange for a refund of any amounts already paid by the Customer for the supply.
Payment Methods
The Customer may pay the price of the Products and the related delivery costs by Credit Card, PayPal, or Bank Transfer. Payments made with all major Credit Cards are accepted, including Visa, MasterCard, and American Express. The transaction will be charged to the Customer's credit card only after: (a) the credit card data have been verified (on a secure server directly by PayPal; we will have no direct access to your data), (b) the debit authorization has been received from the company issuing the credit card used by the Customer, and (c) the availability of the Product has been confirmed by Sikelia Parfums. Sikelia Parfums also accepts payments by Bank Transfer. Any bank fees are the responsibility of the Customer. If, for any reason, it is impossible to debit the amounts due from the Customer, the sales process will be automatically canceled, and the sale will be automatically terminated.
Order Receipt Confirmation
In compliance with Article 53 of the Consumer Code, the Customer receives, at the time of contract execution, via email, confirmation of receipt of the purchase order sent by the Customer, containing a summary of the General Terms, the essential characteristics of the ordered product, its price, the amount paid, the existence of the right of withdrawal—with an indication of the times and methods for returning the goods—the address for any complaints, and information on after-sales services and existing commercial guarantees.
Order Ineffectiveness
No contract shall be considered concluded between Sikelia Parfums and the Customer if Sikelia Parfums has valid reasons to believe that the Customer is not acting on the basis of an actual and genuine interest in purchasing the ordered products or is abusively exercising the right of withdrawal recognized by Article 12 below. In such cases, the order submitted by the Customer shall be considered ineffective. Sikelia Parfums will send the Customer, by email, a notice confirming the non-conclusion of the Contract and will cancel any charges and/or costs to the Customer.
Transport and Delivery
The Products purchased on the Website will be delivered to the address indicated by the Customer. The Customer has the right to request delivery of the products to a designated natural person of their choice. An adult over 18 years of age must sign at the time of delivery. Deliveries will not be made to post office boxes. For each order placed on the Website, Sikelia Parfums issues an invoice for the goods shipped, sending it by email or along with the delivery, pursuant to Presidential Decree 445/2000 and Legislative Decree 52/2004. The invoice will be issued based on the information provided by the Customer when placing the order. No changes can be made to the invoice after it has been issued. Delivery costs are borne by the Customer and are clearly indicated on the Website and in the order form. All purchases will be delivered by express courier contracted by Sikelia Parfums (the "Courier") from Monday to Friday, excluding public holidays and national holidays. Sikelia Parfums is not responsible for unforeseeable delays. Sikelia Parfums will send the Customer an email confirming the shipment of the Products, specifying the shipment tracking number, which can be used to track the shipment status on the Courier's website. In any event, except in cases of force majeure or unforeseeable circumstances, in compliance with the Consumer Code, Products will be delivered within a maximum period of thirty (30) days from the day after the Customer sent the order, unless Sikelia Parfums notifies—within the same period by email—the impossibility of delivering the ordered goods due to the Products becoming unavailable, even temporarily. In the event of such notification, Sikelia Parfums will refund any amounts already paid by the Customer. If, following notification of a delivery delay by Sikelia Parfums, the Customer wishes to cancel the order, any amount already paid will be refunded as soon as possible, and in any case within thirty (30) days from the day after the Customer placed the order. For delivery, the presence of the Customer or their representative at the address indicated is required. Upon delivery by the Courier, the Customer must check that the number of packages corresponds to what is stated in the transport document and that the package is intact and undamaged. Any damage to the package and/or Products or discrepancies in the number of packages must be immediately reported in writing on the Courier's proof of delivery. Once the Courier's document has been signed, the Customer may no longer raise objections regarding the external characteristics of the delivered package.
Duties and Restrictions
Sikelia Parfums is not responsible for any duties or purchase restrictions applied by customs authorities in the destination countries.
Right of Withdrawal
In execution of Legislative Decree of February 21, 2014, no. 21 implementing Directive 2011/83/EU on consumer rights, the Customer may return the purchased product and obtain a refund of the purchase amount actually paid, without any penalty and without specifying the reason. The right of withdrawal consists of the ability to return the purchased products to the seller and consequently obtain a refund of the purchase price of the products themselves. The right of withdrawal may be exercised within 14 days from receipt of the product in the following manner: The costs of returning the purchased products are borne by the consumer. If the value of the products has decreased due to handling other than what is necessary to establish the nature, characteristics, and functioning of the products (by way of example: damaged products, products not properly or completely packaged, or in which certain parts are missing or damaged, such as components, elements, accessories, packaging materials, boxes, documentation, and/or other items), Sikelia Parfums will refund the Customer the purchase amount less the value of such decrease. If the Customer returns products beyond the aforementioned deadline or products that have been opened and/or partially used and are not suitable for return, the right of withdrawal does not apply, and Sikelia Parfums will return the purchased goods to the Customer, charging the shipping costs to the Customer. Subject to the above limitations, Sikelia Parfums will refund the amount actually paid by the Customer within 14 days of receiving the withdrawal notice, via credit note to the bank account or credit card.
Product Replacement
Sikelia Parfums provides its Customers the possibility to replace Products purchased through the Website. To obtain a replacement of a Product, the following procedure must be followed. The Customer who is not fully satisfied must keep all delivery documentation and the Product itself in its original packaging and immediately contact Sikelia Parfums by email at the following address: info@sikeliaparfums.com. The Product to be replaced must arrive, in normal condition, at the following address:

Fulfillment of the new order is subject to the availability of the requested Products. Shipping costs related to returning the Product are borne by the Customer. The replacement Product will be sent to the Customer by courier without additional shipping costs.
Defects of Conformity
In the event of conformity defects in Products sold by Sikelia Parfums via sikeliaparfums.com, the Customer must immediately contact our Customer Service at the email address info@sikeliaparfums.com.
The sale of Products is subject to the legal warranties provided for in Articles 129, 130, and 132 of the Consumer Code. The Customer has the right to have the product’s conformity restored free of charge, by repair or replacement, or to obtain an appropriate price reduction or termination of the contract. The Customer loses these rights if they do not report the lack of conformity to Sikelia Parfums within two months from the date on which they discovered the defect. The action to enforce defects not fraudulently concealed by Sikelia Parfums expires, in any event, within twenty-six months from delivery of the goods.
Errors
The information regarding the Products provided on the Website is constantly updated. However, it is not possible to guarantee the complete absence of errors. Sikelia Parfums reserves the right to correct errors, inaccuracies, or omissions even after an order has been submitted and to change or update information at any time without prior notice.
Governing Law and Jurisdiction
These General Terms are governed by Italian law and must be interpreted in accordance with Italian law. For any disputes arising from the interpretation, validity, and/or execution of these General Terms, the exclusive territorial jurisdiction will be that of the Court of Patti (ME).
